Copyright agency appointed for resale royalty scheme
The Copyright Agency Limited (CAL) has been appointed to act as the collecting society to implement and administer the new resale royalty scheme for visual artists.
The CAL was selected after an open tender process.
The Resale Royalty Right for Visual Artists Act 2009 (the Act), which was passed in December 2009, requires a collecting society to be appointed to set up the resale royalty scheme. The CAL will now be responsible for establishing an advisory body, collecting and paying royalties to artists and educating artists and the broader industry about the scheme.
Under the Act, visual artists are entitled to receive 5 per cent of the sale price of a work which is resold through the art market for $1000 or more. The right applies to all living visual artists and extends for a period of 70 years after an artist’s death. The royalty does not apply to the first sale of an artwork or any sales of artworks that concluded before the scheme started.
The scheme covers artworks such as paintings, drawings, fine art jewellery and multimedia artworks.
The CAL will charge a 10 per cent administration fee for all royalties collected.
